    What Is the NJFLA?

    The NJFLA allows eligible employees to take up to 12 weeks of unpaid, job-protected leave in 24 months. This leave can be used to:

    • Bond with a newborn or newly adopted child
    • Care for a seriously ill parent, child, spouse, or partner
    • Assist a family member impacted by a public health emergency

    Unlike the federal Family and Medical Leave Act (FMLA), NJFLA does not cover leave for your illness, but it provides strong protections for family care needs.

    Eligibility Requirements

    To qualify for NJFLA leave in Fairfield Township, you must meet the following conditions:

    • Work for a company with at least 30 employees
    • Have at least 12 months of service with your employer
    • Worked at least 1,000 hours in the past 12 months

    Eligible employees may take leave all at once or intermittently, depending on the situation and medical needs of their family member.

    What Your Employer Must Do

    Under the NJFLA, your employer is legally required to:

    • Grant eligible leave without interference or retaliation
    • Continue your group health insurance benefits during the leave period
    • Reinstate you to the same or a similar position upon return

    Failure to meet any of these obligations may constitute a violation of your rights.

    • Denying or delaying a valid leave request
    • Firing or demoting you during or after NJFLA leave
    • Discriminating against you for taking time off
    • Failing to inform you of your rights under NJFLA
